Jonathan Yen

Mediator | Arbitrator | Barrister

Jonathan, a member of the Ontario Bar, is a mediator, arbitrator, and counsel in commercial disputes, stakeholder disputes, family disputes, personal injury disputes, property disputes, tax disputes and estate disputes. Jonathan brings to the alternate dispute resolution process over 35 years of practice skills, experience, and knowledge in commercial law, in corporate law, in intellectual property law, in family law, and in courts and tribunals.


Jonathan continues to advise private clients on matters that contribute to their legacies (such as wealth preservation and business succession planning).

A prelude to signing an agreement to mediate, Jonathan extends invitations to the disputants and their respective counsel (i) opportunities to understand the dispute from the perspective of the respective disputants’ business needs, their business relationships, and where applicable, their political and personal agenda and (ii) the option to participate in selecting or drafting rules and procedures for purposes of minimizing unnecessary interruptions of their business operations or their personal lives during their dispute resolution process. There is a higher probability of reaching compromise in cases where disputants and their respective counsel participate in preliminary talks. Jonathan continues to lecture on strategies for early detection and prevention of disputes and on methodology and procedures to manage disputes.


Before entering law school, Jonathan graduated with degrees (H. BSc.) (Psychology (Major) and Physiology (Minor)) from the Faculty of Arts and Science, University of Toronto, and a Master of Business Administration (M.B.A.) from the Schulich School of Business, York University. After graduating with a Bachelor Degree in Law (LL. B.) from the Faculty of Law, University of Toronto, Jonathan earned a Master Degree in Law (LL. M.) from the London School of Economics and Political Science, London, England.

Jonathan, past lecturer at the graduate business program at Schulich School of Business, York University (Business Law and Policy), Ontario Bar admission program (business, taxation law, bankruptcy and insolvency law), and past Treasurer of the Ontario Bar Association, continues to conduct training programs for lawyers and practitioners in negotiation, mediation and dispute identification, prevention and management. Jonathan is active in dispute resolution committees of the American Bar Association, the International Bar Association, the Advocate Society, the Toronto Lawyers Association, Toronto Commercial Arbitration Society (Q. Arb.) and the Society of Tax and Estate Practitioners (TEP).
